Red River Groundwater Conservation District discusses new draft of temporary rules

The Red River Groundwater Conservation District discussed the second draft of its temporary rules on Tuesday. The changes seemed to address many of private well owners’ concerns, but some were still voiced at the meeting.
“You’ve got it up to 27 gallons per minute, but I still think you ought to look at the 50-gallon per minute figure,” said Alex Moser, an area well driller who has been vocal about the threshold since the first draft of the rules was presented.
The second draft raised the threshold for required well registration, metering and fees to 40,000 gallons per day, approximately 27.78 gallons per minute. The previously proposed threshold was 25,000 gallons per day.
“I don’t see the reason in the 27 even,” Moser said. “At 50 I think everybody could breathe a sigh of relief.”
“We’re trying to compromise and meet everybody’s expectations,” said board President Butch Henderson, who represents the small cities of Fannin County.
Henderson explained that state statute says “a well used solely for domestic use or for providing water for livestock or poultry on a tract of land larger than 10 acres that is either drilled, completed, or equipped so that it is incapable of producing more than 25,000 gallons of groundwater a day” be excepted. “And we’re going above that with the 40,000,” Henderson said. The latest draft of rules also removes the 10-acre requirement.
A version of the draft, temporary rules that was posted to the district’s website Wednesday erroneously included the 10-acre requirement, but a corrected version was posted Thursday. “The 10-acre requirement should have been removed, but was overlooked,” said District Secretary Carmen Catterson in an email Thursday.
In the email, Catterson said the rules committee will meet again in early August to continue discussion over exemptions. During Tuesday’s meeting, Henderson told attendees that the rules exempted all domestic use, but the latest version of the rules puts a 40,000 gallon per day threshold on the domestic exemption.
“I spoke with the Rules Committee and there is some confusion on Rule 2.1 (the rule governing exemptions),” Catterson said in the email. “The Committee is going to meet the first week of August to clarify the definition of an exempt well and revise the rules to clarify this matter.

And, personally, I find it fine to not have every instance of “the funnies” be, you know, funny. Moving, thought-provoking, random… it’s all good.
I personally find it laugh-inducing, like all other quality examples of observational humor that is partially an indulgence in laughing at other people; partially a recognition of that same issue in my own life. There is discomfort, perhaps, in the laugh. A bit of a sigh, some sorrow, a realization or a reminder; and frequently enough, a not too bad pun.
